Seeger Weiss LLP provides this privacy policy to assist our visitors in understanding our privacy practices for the personal information we collect on our own behalf when you interact with us, including through our website, DrugDangers.com, email communications, and other Seeger Weiss content (“Site”), and to assist you in making informed decisions when visiting and accessing the information available on our website.

While this Privacy Policy applies generally to interactions visitors to the Site have with Seeger Weiss, it does not specifically apply to client information or case details provided by a potential, current, or past client, for which we limit the use and disclosure of such information to authorized persons, processes, and transactions and which are subject to our professional values, ethical standards, policies, and practices for attorney-client privileged information and, if applicable, in accordance with our engagement agreements in place.

If you do not agree to the terms of this Privacy Policy, please do not use the Site. By accessing, visiting, using, or submitting information to the Site, you consent to the collection and use of information and practices as described in this Privacy Policy. Your use of the Site is also governed by our Terms and Conditions.

1. Collection of Information

We may collect information about visitors of the Site directly, automatically when you visit the Site, and sometimes from third parties. Some of this information may be considered personal information or personal data under various applicable laws. We consider information that identifies you as a specific, identified individual (such as your name, phone number, and email address) to be personal.  We will also treat additional information, including IP addresses and cookie identifiers, as personal where required by applicable law. Note that we may de-identify or pseudonymize personal information so that it is non-personal, such as aggregating or converting it to a code, sometimes using a function commonly known as “hash”. We will treat de-identified or pseudonymized information as non-personal to the fullest extent allowed by applicable law. If we combine non-personal information with personal information, then we will treat the combined information as personal information under this Privacy Policy.

Our Site is intended for a general audience and is not intended for use by or targeted to minors younger than the age of 18. We do not knowingly collect personal information from minors younger than the age of 18.

Information You Provide Directly

When you contact us through a form on our Site, through email, or otherwise express interest in becoming a client of Seeger Weiss LLP, we may ask you to provide certain information directly, including contact information (such as your name, phone number, and email address), demographic information (such as your state of residence), or any other information you choose to submit to us. Note that any information you submit about a potential claim, which may include other information about you or that we can infer about you, is subject to our ethical obligations, including with respect to the attorney-client privilege, and is not governed by this privacy policy.

Information We Collect Automatically When You Access or Use the Site

We and our third-party business partners (including any third-party service providers or third party content, advertising, and analytics providers) may use a variety of technologies, including cookies and web beacons, that automatically or passively collect information whenever you access, use, or otherwise interact with the Site (“Usage Information”). Usage Information includes the hardware model, browser and operating system you are using, the URL or advertisement that referred you to our Site, any search terms you entered into a search engine that led you to our Site, the areas within our Site that you visited, and the time of day you visited our Site, your time zone, location information, and mobile network (if applicable), among other information. We may also automatically collect your IP address or another unique identifier for any computer, mobile phone, or other device used to access our Site.

We use the following tracking technologies (collectively referred to as “Tracking Technologies”) to automatically collect information when you interact with us online:

Cookies and Local Storage. We use cookies and similar tracking technologies to support our Site and to track and improve activity on our Site. Cookies are small text files stored locally on your device that help store user preferences. The technologies are able to store a unique identifier for a device that allows us to recognize the device whenever the device is used to visit the Site. These technologies may be used for many purposes by us, our service providers, and our third-party business partners, such as automatically collecting Usage Information, enabling features, and remembering your preferences. We may use cookies and other technologies to help keep your use of the Site more secure, to study traffic patterns on the Site, and for maintenance purposes. Web Beacons. (also known as “pixel tags” or “clear GIFs”) are small pieces of code used to collect usage analytics. They help us determine, for instance, whether a page has been viewed and if so, how many times. When you ask us to send you information, we may use web beacons to establish when an email has been opened.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

Chat. When you participate in a chat feature we may offer, Seeger Weiss can record, use, and retain your communications and the data you provide in order to respond to you during the chat session, provide support, and to improve our services. If you do not consent, please do not continue with chat assistance.

Social Media Features

The Site may permit you to interact with a third-party platform, for example, the Site may contain links that direct visitors to our social media pages (such as LinkedIn and Facebook)  (“Social Media Features”). Both we and the third party may have access to certain information about you and your use of the Site and the third-party platform. These third-party platforms may collect certain information about your visits to our Site through the Social Media Features we have integrated into the Site, regardless of whether or not you affirmatively interact with the Social Media Features and whether or not you are logged into (or have) an account with the third party platform.

If you use certain Social Media Features, your interaction and personal information may be publicly disclosed on the Site and on the third-party platform. If others give us access to their profile, page, or other content on a third-party platform, we may also receive information about you if it is accessible through that content, as determined by the third-party platform or your connected user.

The information we collect in connection with Social Media Features is subject to this Privacy Policy; the information the third-party platform collects is subject to the third party’s privacy practices (including whether the third party shares information with us, the types of information shared, and your choices about what is visible to others on the third-party platform).

2. How We Use Information

Seeger Weiss LLP may use the information we collect:

  • To enable you to use our Site (and view our content offered through the Site);
  • To process information you provided through the Site, including verifying that your email address is active and valid and to evaluate your potential claim;
  • To respond to Site visitors who have contacted us;
  • To send you marketing emails, including newsletters & firm updates;

3. How We Share Information

We may share non-personal information that we collect, such as certain Usage Information, aggregated user statistics, hashed or otherwise de-identified or pseudonymized information (including email addresses), with third parties in our discretion and as permitted by law, including for targeted advertising purposes. We do not share personal information with third parties for those third parties’ own marketing purposes without your explicit, opt-in consent. In addition, we may disclose your information, including personal information, to third parties with your consent, as disclosed at the time we collect the information, as otherwise described in this Privacy Policy, and under the following circumstances:

Service Providers: We use third-party service providers to assist us with the operation of the Site or to perform other services for us or on our behalf, including to send emails and other communications. We give these third parties access to your personal information (or allow them to collect information from or about you) so that they can provide the services. Our third-party service providers may be located in the U.S., Canada or other foreign jurisdictions.

Business Transfers/Merged or Acquiring Entity: Information about the Site and its visitors are a business asset of Seeger Weiss LLP. Therefore, information about our visitors, including personal information, may be disclosed without your further consent as part of any corporate restructuring, including a merger or acquisition, creation of a separate business to provide the Site or services; debt financing, sale or pledge of company assets, insolvency, bankruptcy or receivership in which personal information would be transferred as one of Seeger Weiss LLP’s business assets, or other transaction (including, without limitation, during the course of any due diligence process). Employment Applications: If you apply for a job with Seeger Weiss, please note that we use a careers portal that is operated by a third party, and we or our service provider(s) may ask you to provide self-identifying data (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission and other federal, state, and local regulatory agencies. Providing such self-identifying data is voluntary, but if you do provide such data, we and/or our service providers may submit that data to the appropriate government or regulatory agencies to fulfill reporting requirements, use the data for diversity, equity, and inclusion analysis and reporting, and use that data to defend against employment-related complaints.

4. Third Party Analytics and Advertising Providers

We may work with third party business partners (such as analytics and advertising providers) to provide us with information regarding use of and traffic on the Site (including without limitation the pages viewed and the actions users take when visiting the Site). These third parties may set and access their own tracking technologies on your device (including without limitation cookies and web beacons) and may otherwise collect or have access to information about you (such as Usage Information and device identifiers, some of which may be personal information under various state laws). Some of these parties may collect personal information over time when you visit the Site or other online websites and services. We may share certain information such as device identifiers, Usage Information, pseudonymized, and de-identified information with these analytics and advertising providers.

One analytics provider with whom we may work is Google Analytics. Google Analytics uses cookies and similar technologies to collect and analyze information about use of the Site and report on activities and trends. This service may also collect information regarding the use of other websites, apps, and online resources. 5. Do Not Track Signals

Some browsers may be configured to send “Do Not Track” signals to the online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, our Site does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser, except as required by applicable law. 6. Your Choices

You are responsible for maintaining the accuracy of the information you submit to us. You may request that we update, correct, or delete the personal information you have provided by contacting us at intake@seegerweiss.com. We will make good faith efforts to make requested changes in our active databases as soon as reasonably practicable. Please note that it is not always possible to make changes on our backup databases and residual data may remain on backup media or for other reasons.

If you receive marketing communications from Seeger Weiss you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in the emails

Please note that we reserve the right to send you certain communications relating to your account or use of our Site or our services, such as administrative and service announcements and these transactional account messages may be unaffected if you choose to opt-out from receiving our marketing communications.

7. Consent to Transfer (Visitors Located Outside the U.S.)

Seeger Weiss LLP is a United States law firm based in the United States. If you use our Site outside of the United States, by using the Site and/or providing us with information, you understand, acknowledge, and agree that we may collect, process, and store your personal information in the United States and other countries for the purposes described in this Privacy Policy. By providing your information, you fully understand and unambiguously consent to this transfer, processing, and storage of your information in the United States and other jurisdictions, where laws regarding processing of personal information may be less stringent than the laws in the country where you reside and/or are a citizen. Personal information processed or stored in another jurisdiction may be subject to access requests from governments, courts, or law enforcement in accordance with the laws of that jurisdiction.

We use commercially reasonable security measures to protect against loss, misuse, and alteration of your personal information under our control. However, no system can be guaranteed 100% secure. We therefore cannot ensure or warrant the security of any information that you transmit to us, or that we transmit to you, or guarantee that it will be free of unauthorized access by third parties. While we strive to protect your personal information, you use our Site and provide us with your information at your own initiative and risk, and should take care to limit your electronic submissions to information that is not highly sensitive or valuable to you.

9. Third Party Links and Content

The Site may contain links to other web sites that Seeger Weiss LLP does not control, and other content hosted and served by third parties. The third parties whose content appears on the Site may collect information about you through the use of cookies and web beacons, may independently collect or solicit personal information, and may have the ability to track your use of their sites and services. Likewise, our content may be included on third parties’ web pages and web sites that are not associated with Seeger Weiss LLP and over which we have no control.

This Privacy Policy does not apply to non-Seeger Weiss LLP websites or mobile applications that may link to the Site or be linked to or from the Site. Please review the privacy policies on those websites or applications directly to understand their privacy practices. Seeger Weiss LLP is not responsible for the privacy practices of any third party.

10. Changes to this Privacy Policy

To the extent allowed by applicable law, we may make changes to this Privacy Policy from time to time in our discretion. We will notify you of such changes by posting the new policy on the Site and indicating at the top of the Privacy Policy the date it was last updated. We may also provide notice to you in other ways in our discretion, such as through contact information you have provided. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified, and your continued use of the Site after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will constitute your consent to those changes to the fullest extent allowed by applicable law.
